  • Covid Vaccine Injury Suit May Fuel Federal Overhaul, Litigation
    A lawsuit by Covid-19 vaccine recipients claiming they were injured by their shots may usher in long-awaited changes to how the federal government handles immunization injuries.

    Individuals frustrated by the HHS program designed to compensate them for their injuries are taking their grievances to court. In a lawsuit lodged with the US District Court for the Western District of Louisiana, they say the program is unconstitutional, depriving them of their rights to due process and a jury trial.

    Lawyers say the move could spur Congress and the Department of Health and Human Services to reform how they handle vaccine injuries, as well as push more of the individuals alleging injuries to not just sue the government, but the drugmakers that the program is meant to shield from litigation.

    “‘This is the first domino to fall,” said David Carney, a Green & Schafle LLC attorney representing people injured by vaccines. “We’re going to start to see a windfall.”

    For years, attorneys and activists representing Americans injured by routine vaccinations have been pushing lawmakers to reform how the HHS reviews requests for compensation. They say that the process, dubbed the Vaccine Injury Compensation Program, is in desperate need for more special masters to review the backlog of nearly 4,000 injury claims.

    Congress, they add, needs to expedite the process for adding new vaccines to the program, though lawmakers have yet to pull the trigger on legislation that’s been several years in the works.

    Covid vaccine injuries are not among those currently under the VICP. Those are filed with the HHS’ Countermeasures Injury Compensation Program.

    Created in 2010 to pay out damages for people injured in sudden health crises like Ebola and the Anthrax scare, critics say the CICP program is slow moving, opaque, and poorly equipped for handling the nearly 11,000 claims alleging Covid-related injuries awaiting or in review as of Oct. 1. And with a little more than 1,000 decisions reached, vaccine attorneys don’t expect the others to be resolved any time soon.

    Vaccine law experts say the path forward is reforming the VICP and bringing Covid-19 immunization injuries under its umbrella. But doing so takes both the HHS and Congress, and attorneys say efforts from both appear lagging.

    ‘Best Interest’

    Adding a vaccine to the VICP is no small feat. The HHS first has to recommend a jab for routine administration to children, and then the agency has two years to recommend that it be covered by the VICP.

    In the case for Covid vaccines, the HHS has already recommended jabs for routine administration to children. Through informal conversations with HHS employees, Carney said he and others in the vaccine law space were led to believe Covid vaccines were going to be moved over to the VICP, though the agency has yet to take any action to make that happen.

    Now, people suffering injuries allegedly from Covid vaccines “feel like the government is not acting in their best interest,” and are hiring attorneys, he said.

    The burden, however, doesn’t entirely lie with the HHS. In order for the VICP to actually pay out for Covid injuries, Congress would have to sign off on taxing the doses for the program, a process that applies to any vaccine added to the program.

    Over the past several years, lawmakers have put forth legislation to modernize the program. Earlier this year, Reps. Lloyd Doggett (D-Texas) and Lloyd Smucker (R-Pa.) introduced bills that would move pending Covid-19 vaccine injury claims to the VICP, bring on more special masters to review cases, and eliminate the need for Congress to sign off on a tax for every vaccine added to the table.

    In October, React19—a group for people injured by Covid vaccines and a plaintiff in the lawsuit—briefed lawmakers about the need for changes.

    Renee Gentry, director of George Washington University Law School’s Vaccine Injury Litigation Clinic, presented alongside React19 and has been urging lawmakers for reforms for a decade.

    When it comes to getting Congress on board, she said “talking about vaccine on the Hill is a little bit like walking on the edge of a razorblade that’s on fire.”

    “It’s a very, very subtle dance up there,” she said, adding it’s nearly impossible to have a “reasoned, calm, specific” conversation about vaccines.

    Insufficient Remedy

    An HHS spokesperson likewise called out Congress for not fully funding the HHS’s budget request for the CICP, though noted the agency has tried making “meaningful CICP process improvement,” such as bringing on more medical reviewers and improving communications with people requesting benefits from the program.

    The spokesperson also said the Health Resources and Services Administration, the HHS entity that oversees the VICP and Countermeasures Program, is “working to establish” a table that would “list and explain injuries that, based on the statutory compelling, reliable, valid, medical, and scientific evidence standard, are presumed to be caused by covered COVID-19 countermeasures.”

    Gentry, however, said there’s a growing frustration with the CICP’s handling of Covid claims, and that the program is “not appropriate for anything on this scale.”

    In total, 12,233 Covid-19 claims have been filed with the CICP. More than 9,000 of those allege Covid-19 vaccines were involved in injuries or deaths. That’s the bulk of the 12,775 claims brought to the program over the past 13 years.

    While only a small fraction of Countermeasure Program’s Covid claims have been addressed, the overwhelming majority of those—1,235—have been denied. Most missed a filing deadline.

    The program has deemed 32 claims eligible for compensation; only 6 have resulted in compensation, all of which involved Covid-19 vaccines.

    “An unsatisfactory remedy has now shown itself to be unsatisfactory,” said Christina Ciampolillo, past president of the Vaccine Injured Petitioners Bar Association. “There’s not a lot of promise that you can point to for changes to the CICP in the future.”

    Nevertheless, in May, the HHS extended liability protections under the CICP until the end of 2024. After that, Ciampolillo said, it becomes an open question as to whether Covid vaccine manufacturers would be open to lawsuits from people alleging injury.

    “There’s a deadline there,” said Ciampolillo, an attorney at Conway Homer PC. “That’s kind of the no man’s land that everybody is wondering about.”

    More Lawsuits

    The lawsuit against the HHS may serve as the catalyst for ushering in change.

    “If case does move forward, I would suspect HHS would work more closely in concert to finally get these important bills that will streamline compensation moving,” said Brianne Dressen, co-chair of React19 who experienced blurred vision, severe paresthesia, and other afflictions after a shot of AstraZeneca’s Covid vaccine during a clinical trial.

    However, should the case fail, Dressen said her group would “continue to seek other avenues through the legal system,” including “other types of lawsuits” and applying more “pressure in the halls of Washington.”

    Likewise, vaccine injury attorneys said more lawsuits could follow.

    “There’s probably a large number of injured people, and the more negative outcomes that are realized through the CICP, I think you’ll have more frustrated individuals,” Ciampolillo said.

    The CICP essentially shields drugmakers from lawsuits. But Carney said that given there’s “not a sufficient legal forum to adjudicate” Covid-19 injury claims and that the CICP isn’t “a suitable alternative to civil tort litigation,” it is arguable that pharmaceutical companies could be next in line to be sued.

    “Very soon, we’re going to see people sue the vaccine manufacturers,” Carney said.

    Texas Attorney General Ken Paxton has sued Pfizer and its drug manufacturer for allegedly providing medicine it knew to be ineffective.

    In a lawsuit unsealed Monday, Paxton sued Pfizer, Inc., Tris Pharma, Inc. and Tris CEO Ketan Mehta, accusing both companies of defrauding the state to get children's ADHD medicine Quillivant XR added to the state’s list of preferred drugs under the Medicaid insurance program for low-income people. The drug previously failed to meet quality standards, he said.

    According to Paxton, Pfizer and Tris "continually" manipulated quality-test results from 2012 to 2018 to obtain the benefit of taxpayer-funded Medicaid reimbursement for Quillivant.

    "For years, Tris altered the drug’s testing method in violation of federal and state laws to ensure Quillivant passed regulatory hurdles and could continue to be sold. Despite knowing about these serious problems, Pfizer misrepresented to the Medicaid program that Quillivant was in compliance with federal and state law," he claimed.

    "I am horrified by the dishonesty we uncovered in this investigation," said Paxton. "Pfizer and Tris intentionally concealed and failed to disclose the issues with Quillivant to receive taxpayer-funded benefits through Texas Medicaid, defrauding the state and endangering children. Our Civil Medicaid Fraud Division has done an outstanding job holding these pharmaceutical companies accountable."

    UNITED STATES: Bayer AG (ETR:BAYGN), a prominent German company in the pharmaceutical and agriculture sectors, experienced its largest-ever drop in market value, a staggering loss of approximately €7.6 billion (US$8.3 billion).

    This downturn follows substantial legal issues and setbacks in drug development, intensifying the pressure on the company’s new leadership to articulate a comprehensive turnaround strategy.

    The company’s shares, traded on the Frankfurt Stock Exchange, plummeted by 20%, reaching their lowest point since 2009.

    This decline marks a 30% decrease in share value over the course of this year.



    One of the setbacks occurred when Bayer announced on Sunday (19 Nov) that the late-stage testing of a drug named asundexian, intended for heart disease treatment, would be halted due to its apparent lack of effectiveness.

    Initially projected in January to potentially yield sales surpassing US$5 billion, asundexian was anticipated to be a cornerstone in Bayer’s pharmaceutical portfolio for driving growth.

    Bayer’s Monsanto faces second wave of lawsuit

    Simultaneously, a significant legal blow struck Bayer when a Missouri Circuit Court, in a landmark ruling late on a Friday, mandated that Bayer AG’s subsidiary, Monsanto, must pay a combined sum exceeding US$1.5 billion to three former users of the company’s weed killing product, Roundup.

    These individuals attributed their cancers to the controversial product in what became one of the company’s most substantial trial losses related to the herbicide.

    This verdict adds to a series of recent legal challenges against Monsanto, citing carcinogenic properties in Roundup.

    Notably, the sum of over US$1.5 billion stands as one of the largest damage awards imposed on a US corporate defendant this year.

    Bayer has indicated its intention to contest the verdicts and maintains its stance that the product, Roundup, is safe.

    According to Fortune, these recent developments intensify the challenges for Bill Anderson, who assumed the role of chief executive in June.

    Anderson revealed this month that he’s considering a potential split of the conglomerate into separate entities focused on pharmaceuticals and agriculture.

    Anderson steps into leadership at Bayer during a period fraught with difficulties, particularly stemming from the US$63 billion acquisition of Monsanto, which has soured.

    Additionally, the pharmaceutical unit grapples with patent expirations affecting critical treatments.

    Currently, Bayer is embroiled in another Roundup trial, this time before a state court jury in Philadelphia, involving a plaintiff attributing his cancer to the weed killer.

    The trial is ongoing, and closing arguments are anticipated later this month or in early December, as per lawyers involved in the case.

    Furthermore, another case is scheduled to commence in California in December, while at least three additional cases are slated to begin in Philadelphia in the upcoming months.

    Singapore sovereign fund Temasek invested in Bayer in 2018

    In April 2018, Singapore’s sovereign fund Temasek Holdings decided to invest in Bayer. It bought 3.6 per cent stake for 3 billion euros at 96.77 euros per share at the time.

    The money is used as part of Bayer’s plan to takeover Monsanto. Together with its existing holding in Bayer, Temasek would then own about 4 per cent in Bayer after the transaction.

    By June 2018, with Temasek’s help, Bayer successfully acquired Monsanto to become the biggest seed and agricultural chemical maker in the world.

    However, since the acquisition, lawsuits have been mounting in the US whether Monsanto’s “Roundup” causes cancer.

    Two months after Temasek helped Bayer to acquire Monsanto, in a landmark verdict in August 2018, Monsanto was ordered by a San Francisco court to pay US$289 million in punitive damages and compensatory damages. Bayer’s subsidiary, Monsanto, appealed several times, but lost.

    So far, since the acquisition of Monsanto 5 years ago, Bayer agreed to settle much of that litigation for US$10.9 billion in 2020. As of February this year, about 100,000 claims had been settled or deemed ineligible. Nevertheless, some 40,000 cases are still pending.

    In June, Bayer’s share price was around 52.33 euros, but now it plummetted to merely 33.99 euros as of Wednesday (22 Nov).

    A quick check online shows Temasek is still largely holding on to Bayer’s share. It is the largest shareholder of Bayer with 3.5% of holdings.

    Since Temasek bought 3 billion euros worth of shares at 96.77 euros in 2018, five years ago, that means it has lost 62.78 euros per share or approximately 64% of the original 3 billion euros investment.

    This amounts to about 1.9 billion euros or approximately S$2.7 billion of losses.

    Five countries have asked the International Criminal Court (ICC) to investigate the situation in Palestine, ICC Prosecutor Karim Khan said on Friday, according to TASS Russian News Agency.

    These five countries are Bangladesh, Bolivia, Djibouti, South Africa, and the Comoros.

    “We are opposed to the operation that is ongoing, particularly as it is now targeting hospitals where babies, women, and the injured are dying like flies,” the South African President Cyril Ramaphosa announced on Wednesday during a two-day visit to Qatar.

    South Africa refers Israel to International Criminal Court for Genocide in Gaza

    On Wednesday, Ramaphosa claimed that while South Africa, an active supporter of Palestinian sovereignty, does not endorse the Hamas incursion, the Israeli response amounts to genocide that warrants an ICC investigation.

    “There is a need for the whole world to rise and call for the Israeli government to ceasefire, and stop what is happening and the ICC to investigate. Of course, legal measures need to be taken at a global level,” he added.

  • Biden’s Legacy Should Be Forever Haunted by the Names of Gaza’s Dead Children
    Biden’s support for the terror bombing of Gaza continues his long history as a steadfast supporter of Israel’s greatest crimes.

    As Israel intensified its attacks on Gaza last week, including strikes against multiple hospitals, and presided over a forced exodus of hundreds of thousands of civilians from their homes, President Joe Biden was asked about the chances of a Gaza ceasefire. “None,” Biden shot back. “No possibility.”

    With a death toll that has now surpassed 11,000 Palestinians, including nearly 5,000 children, the extent of Biden’s public divergence from his “great, great friend” Benjamin Netanyahu’s scorched-earth war of annihilation amounts to meekly worded suggestions of “humanitarian pauses.”

    On Friday, Secretary of State Antony Blinken remarked, “far too many Palestinians have been killed; far too many have suffered these past weeks, and we want to do everything possible to prevent harm to them and to maximize the assistance that gets to them.” These disingenuous platitudes melt into a puddle of blood when juxtaposed with the administration’s actions.

    The Biden administration has funneled weapons, intelligence support, and unwavering political backing for Israel’s public campaign to erase from the earth Gaza’s existence as a Palestinian territory. As Israeli settlers wage campaigns of terror against the Palestinians in the West Bank, the U.S. remained entrenched in its global isolation, voting last week against a U.N. resolution demanding an end to the illegal settlements. The resolution condemned illegal Israeli settlements, calling them “illegal and an obstacle to peace.” The resolution, which passed 145-7, called for “the immediate and complete cessation of all Israeli settlement activities in all of the Occupied Palestinian Territory.” Only five countries joined the U.S. and Israel in voting “no”: Canada, Hungary, the Marshall Islands, Micronesia, and Nauru.

    As the capitals of major world cities have seen massive protests on a scale not registered since the 2003 Iraq invasion, Netanyahu has been on a U.S. media blitz, appearing on Sunday talk shows to cast the stakes of his war “to destroy Hamas” as akin to World War II. “Without it none of us have a future. And it’s not only our war, it’s your war too. It’s the battle of civilization against barbarism,” he said on CNN’s “State of the Union.” “And if we don’t win here, this scourge will pass. The Middle East will pass to other places. The Middle East will fall. Europe is next. You will be next.”

    Netanyahu has brazenly exploited the grief of Israeli citizens whose lives were torn apart on October 7 when Hamas launched a series of coordinated attacks inside Israel. Those raids resulted in the deaths of 846 civilians, 278 Israeli soldiers, and 44 police officers, according to the latest figures provided by Israel. Some family members of the victims, as well as relatives of the 240 hostages taken by Hamas and other militant groups — among them infants and the elderly — have emerged as some of the most vocal critics of Netanyahu’s government. A small number have spoken out against his attacks on Gaza, though their voices are largely drowned out by pro-war voices in Western media coverage.

    “I beg you, I beg also my government, and the pilots and soldiers, who may be called to go into Gaza. Don’t agree. Protect the area around the Gaza Strip, but don’t agree to go in and kill innocent people,” said Noy Katsman, whose older brother Hayim was killed on October 7 at the kibbutz he had lived on for a decade. Maoz Inon’s parents were also killed that day. “Today, Israel is repeating an old mistake it made many times in the last century. We must stop it,” Inon wrote. “Revenge is not going to bring my parents back to life. It is not going to bring back other Israelis and Palestinians killed either. It is going to do the opposite. It is going to cause more casualties. It is going to bring more death.”

    Over the past month, Biden has cast doubt on the extent of Palestinian civilian deaths, defended Netanyahu’s violent extremist agendas, and made clear that the U.S. position amounts to this: collectively punishing Palestinians for the actions of Hamas falls under the doctrine of “self-defense.” Biden has stood by Israel as government officials have openly described an agenda of ethnically cleansing Palestinians, proclaiming a “Gaza Nakba,” threatening to do to Beirut what Israel has done to Gaza, labeling hospitals and ambulances “legitimate military targets,” and accusing U.N. workers of being Hamas and journalists of being “accomplices in crimes against humanity.” More than 100 U.N. workers and at least 40 journalists and media workers have been killed in Gaza since October 7. Approximately one in 200 Palestinians have died in Gaza since the start of Israel’s attacks.

    National security adviser Jake Sullivan, when asked Sunday on CNN if Israel is abiding by the rules of war, replied, “I’m not going to sit here and play judge or jury on that question. What I’m going to do is state the principle of the United States on this issue, which is straight forward: Israel has a right, indeed a responsibility, to defend itself against a terrorist group.” The U.S. is simultaneously increasing the flow of weapons to Israel — and Biden proposed $14.5 billion in additional military assistance — while its senior national security official cannot state whether Israel is conducting operations in contravention of international law.

    Keenly aware of the growing opposition to Israel’s war at home and abroad, and even within his own administration, Biden and his advisers have sought to push a narrative that they are seeking to moderate Israel’s tactics. They make sure the U.S. press know that Biden had urged against a full-scale ground invasion, proposed limited pauses to the bombing, and expressed concerns about the humanitarian crisis for Palestinian civilians. On Monday, after days of relentless Israeli attacks on Gazan hospitals and desperate pleas from international doctors and health and aid organizations, Biden finally addressed the issue, but only after being directly asked. “Hospitals must be protected,” he said in response to a question from the press. “My hope and expectation is that there will be less intrusive action relative to hospitals.”

    The White House’s mounting effort to spin itself as being concerned about civilian deaths and doing all it can to urge Israel to avoid massacring civilians on an industrial scale is an effort to obfuscate the U.S. role as Israel’s central ally enabling this slaughter. It is a grotesque parlor game that only works if facts and history don’t matter. And in Biden’s case, that history is extensive.

    Support for Israel’s Wars

    For 50 years, Biden has been consistent in his support for Israel’s wars against the Palestinians. Time and again he has backed and facilitated campaigns of terror waged by a nuclear power against a people who have no state, no army, no air force, no navy, and an almost nonexistent civilian infrastructure. As Gaza burns in a smoldering pyre of death and destruction, 80-year-old Biden may be overseeing the final act in his devotion to Israel’s most extreme agenda. His legacy should be forever haunted by the names of the dead children of Gaza, thousands of whom have died in a matter of weeks under the hellfire of U.S.-manufactured weapons and support.

    Biden has been in public office longer than almost any U.S. politician in history. His career in the U.S. Senate began on the eve of the 1973 Arab–Israeli war when he traveled to meet Israeli Prime Minister Golda Meir. “I sat across the desk for an hour as she flipped those maps up and down, chain smoking, telling me about the [1967] Six Day War,” Biden said. He called it “one of the most consequential meetings I’ve ever had in my life.” But, as has been in the case with more than a few of Biden’s vignettes about his central role in historical events, in his numerous and varied retelling of that story, he seems to have exaggerated how important that meeting was to Meir and the Israelis.

    Joe Biden: Career Defender of Israel’s Crimes and Impunity

    Over the ensuing decades and up to the current horrors being inflicted on the people of Gaza, Biden has operated as one of the staunchest promoters of Israel’s colonialist agenda, often defending Israel’s disproportionate use of force, collective punishment, and at times outright massacres. “Were there not an Israel, the United States would have to invent an Israel to protect her interests in the region,” Biden said on the Senate floor in 1986. He repeated that same line earlier this year during a July visit by Israeli President Isaac Herzog to Washington. During Biden’s trip to Israel last month, as Israel intensified its attacks on Gaza and the civilian death toll skyrocketed, he told Netanyahu and his war cabinet, “I don’t believe you have to be a Jew to be a Zionist, and I am a Zionist.”

    Building support for Israel’s military might and funneling money and political support to Israel has been a central component of Biden’s career-long foreign policy agenda. He is fond of calling himself “Israel’s best Catholic friend.” In 2016, during a visit to Israel, Netanyahu heaped praise on Biden, then vice president. “The people of Israel consider the Biden family part of our family,” he said. “I want to thank you personally for your, for our personal friendship of over 30 years. We’ve known each other a long time. We’ve gone through many trials and tribulations. And we have an enduring bond that represents the enduring bond between our people.”

    There is one story from these decades of Biden’s dedication to Israel that seems eerily prescient given the bloodbath playing out in Gaza right now. It took place early in the Israeli invasion of Lebanon in 1982. In public, Biden was neither a cheerleader for the invasion nor an opponent. But in a private meeting of the Senate Foreign Relations Committee with Prime Minister Menachem Begin in June 1982, Biden’s support for the brutality of the invasion appeared to outstrip even that of the Israeli government.

    As the Israeli prime minister was grilled in the Senate over Israel’s disproportionate use of force, including the targeting of civilians with cluster bomb munitions, Biden, in Begin’s words, “rose and delivered a very impassioned speech” defending the invasion. Upon his return to Israel, Begin told Israeli reporters he was shocked when Biden “said he would go even further than Israel, adding that he’d forcefully fend off anyone who sought to invade his country, even if that meant killing women or children.” Begin said, “I disassociated myself from these remarks,” adding, “I said to him: No, sir; attention must be paid. According to our values, it is forbidden to hurt women and children, even in war. Sometimes there are casualties among the civilian population as well. But it is forbidden to aspire to this. This is a yardstick of human civilization, not to hurt civilians.”

    Coming from Begin, the comments were striking, because he had been notorious as a leader of the Irgun, a militant group that carried out some of the worst acts of ethnic cleansing accompanying the creation of the state of Israel, including the 1948 Deir Yassin massacre. The details of his exchange with Biden about Lebanon did not receive attention in the U.S. press. Instead, the New York Times focused on what it termed the “bitterest exchange” between Biden and Begin over the issue of Israeli settlements, which Biden opposed because, he said, it was hurting Israel’s reputation in the U.S. “He hinted — more than hinted — that if we continue with this policy, it is possible that he will propose cutting our financial aid,” Begin alleged.

    Over the years, Biden has referenced this confrontation when explaining his opposition to the expansion of Israeli settlements in the West Bank as a disagreement among very good friends. Biden has long argued that these expansions undermine prospects for a peace agreement between Israel and the Palestinians, though his rhetoric has often been contradicted by his actions, as was the case with his opposition to last week’s U.N. vote labeling the settlements illegal.

    “Innocents Got Killed”

    In the 1990s, as Biden solidified his reputation as a top foreign policy senator, he often helped shepherd legislation and funding packages to Israel that human rights groups and international aid organizations said would hinder efforts at brokering lasting peace and further entrench the state of apartheid imposed on millions of Palestinians in the West Bank and Gaza.

    Biden was an early proponent of moving the U.S. Embassy in Israel to Jerusalem, a move that finally took place in 2018 under the Trump administration. In 1995, Biden helped pass a Senate resolution demanding that the embassy be moved by May of that year. Despite objections that it would harm ongoing Israeli–Palestinian peace talks by deciding a key issue by fiat, Biden said the move would send a positive signal to the region. “To do less would play into the hands of those who would do their hardest to deny Israel the full attributes of statehood,” Biden said.

    In 2001, following rare public criticism from the Bush administration directed at Israel’s policy of assassinating suspected Palestinian militants, Biden defended Israel’s right to carry out such killings and even rebuked President George W. Bush for criticizing them. “My view has always been that disagreements between Israel and the United States, those differences should be aired privately, not publicly,” Biden said. He also defended the legality of targeted killings, which at the time were considered highly questionable by legal experts for occurring outside a declared conflict. “I don’t believe this is a policy of assassinations,” Biden said, referring to the targeting of suspected Hamas members. “There is in effect a declared war, a declaration by an organization that has said its goal is to do as much as it can to kill Israeli civilians.”

    In July 2006, Israel was bombing both Gaza and southern Lebanon, with Biden cheering it on. The Israelis, Biden said on MSNBC, “have in both cases, both in Gaza and in southern Lebanon, done the right thing.” In the face of international condemnations of Israel’s brutality in its attacks, Biden defended Israel. “I find it fascinating — people talk about, ‘Has Israel gone too far?’ No one talks about whether Israel’s justified in the first place,” he said on “Meet the Press.” Unless critics of Israel recognize that it was a victim of terrorism, he said, “I think it’s awful — I think it’s a secondary question whether Israel’s gone too far.”

    Biden said his “only criticism of the Israelis is they’re not that great at public relations.” He compared Israel’s attacks on Gaza and Lebanon to the U.S. invasion and occupation of Afghanistan after the September 11 attacks. “It’s a little bit like the same thing we had when we went into Afghanistan,” Biden said at a press conference in July 2006. “We went into Afghanistan, remember, we took out a wedding party by accident? Remember, we took out — with these very sophisticated missiles we had, we accidentally killed some citizens? Was ever a war more justified than us going into Afghanistan? I can’t think of any war since World War II more justified. Yet innocents got killed in us trying to protect America’s interests.” By August 2006, more than 1,000 people were killed in Israel’s war against Lebanon, and UNICEF estimated that 30 percent of the casualties were children.

    During his time as vice president, Biden often played the role of placating his friend Netanyahu who famously loathed President Barack Obama. During those eight years, Obama largely maintained long-standing U.S. posture of showering Israel with weapons and other aid despite repeated political spats with Netanyahu, most prominently over Iran and Israeli settlements. During numerous episodes when Israel unleashed gratuitous violence, drawing international condemnation, Biden served as Israel’s most prominent American defender.

    In the early summer of 2010, a group of mostly Turkish activists attempted to deliver a flotilla of humanitarian aid to the besieged Gaza Strip. The attempt was interdicted by the Israeli military, which launched a raid on one ship that resulted in the deaths of nine people, including one American citizen. The raid triggered an international outcry and led to a diplomatic crisis between Israel and Turkey, while drawing further attention to the civilian impact of the ongoing Israeli siege of Gaza.

    Biden took the lead in defending the raid to the U.S. public. In an interview with PBS, he described the raid as “legitimate” and argued that the flotilla organizers could have disembarked elsewhere before transferring the aid to Gaza. “So what’s the big deal here?     Following Hamas’s horrifying attacks on October 7, Biden and his administration have defended Israel’s mass bombardment of Gaza, and U.S. weapons shipments have been accelerated. Biden called his proposal for additional military support an “unprecedented commitment to Israel’s security that will sharpen Israel’s qualitative military edge,” saying, “We’re going to make sure other hostile actors in the region know that Israel is stronger than ever.”

    This crisis has undoubtedly solidified Biden’s legacy as one of the premiere American defenders of Israel’s crimes, including disproportionate attacks against an overwhelmingly defenseless civilian population, in the history of U.S. politics.

    In an alternate reality — one where the rule of law is applied equally to all states — Israeli leaders would likely face war crimes charges for the razing of Gaza. Leading genocide scholars and international law experts have cited the statements of Israeli officials about the aims of their operations in Gaza as potential evidence of “genocidal intent.” A coalition of international lawyers representing Palestinian rights groups has already petitioned the International Criminal Court to open a criminal inquiry and issue arrest warrants for Netanyahu and other officials.

    Such attempts at accountability should not focus solely on Israeli leaders, according to some U.S. constitutional law organizations. The U.S. is Israel’s premiere bankroller and arms dealer, not to mention its political defender. There are several U.S. laws and treaties that prohibit support for, and failure to prevent, genocidal activities. Among these is the Genocide Convention Implementation Act, signed into law in 1988. Its sponsor? A senator named Joe Biden.

    On Monday, the Center for Constitutional Rights filed a federal lawsuit on behalf of Palestinians in Gaza seeking to block the Biden administration from providing further military aid to Israel. The suit names Biden, Blinken, and Defense Secretary Lloyd Austin. “They have continued to provide both military and political support for Israel’s unfolding genocidal campaign while imposing no red lines,” said Katherine Gallagher, one of the lawyers who filed the case. “The United States has a clear and binding obligation to prevent, not further, genocide. They have failed in meeting their legal and moral duty to use their considerable power to end this horror. They must do so.”

    It is unfathomable, given the current world order, that any meaningful legal accountability will be served on U.S. or Israeli leaders. But on a moral level, it is important to remember these legal efforts to confront the slaughter and the complicity of Biden and other Western leaders. The U.S.-enabled horrors of the past five weeks should remain a bloody, permanent stain on the fabric of Biden’s political career and legacy. Among the U.S. political elite, it will simply be noted as Biden doing his job.

The Biden administration has funneled weapons, intelligence support, and unwavering political backing for Israel’s public campaign to erase from the earth Gaza’s existence as a Palestinian territory. As Israeli settlers wage campaigns of terror against the Palestinians in the West Bank, the U.S. remained entrenched in its global isolation, voting last week against a U.N. resolution demanding an end to the illegal settlements. The resolution condemned illegal Israeli settlements, calling them “illegal and an obstacle to peace.” The resolution, which passed 145-7, called for “the immediate and complete cessation of all Israeli settlement activities in all of the Occupied Palestinian Territory.” Only five countries joined the U.S. and Israel in voting “no”: Canada, Hungary, the Marshall Islands, Micronesia, and Nauru. As the capitals of major world cities have seen massive protests on a scale not registered since the 2003 Iraq invasion, Netanyahu has been on a U.S. media blitz, appearing on Sunday talk shows to cast the stakes of his war “to destroy Hamas” as akin to World War II. “Without it none of us have a future. And it’s not only our war, it’s your war too. It’s the battle of civilization against barbarism,” he said on CNN’s “State of the Union.” “And if we don’t win here, this scourge will pass. The Middle East will pass to other places. The Middle East will fall. Europe is next. You will be next.” Netanyahu has brazenly exploited the grief of Israeli citizens whose lives were torn apart on October 7 when Hamas launched a series of coordinated attacks inside Israel. Those raids resulted in the deaths of 846 civilians, 278 Israeli soldiers, and 44 police officers, according to the latest figures provided by Israel. Some family members of the victims, as well as relatives of the 240 hostages taken by Hamas and other militant groups — among them infants and the elderly — have emerged as some of the most vocal critics of Netanyahu’s government. A small number have spoken out against his attacks on Gaza, though their voices are largely drowned out by pro-war voices in Western media coverage. “I beg you, I beg also my government, and the pilots and soldiers, who may be called to go into Gaza. Don’t agree. Protect the area around the Gaza Strip, but don’t agree to go in and kill innocent people,” said Noy Katsman, whose older brother Hayim was killed on October 7 at the kibbutz he had lived on for a decade. Maoz Inon’s parents were also killed that day. “Today, Israel is repeating an old mistake it made many times in the last century. We must stop it,” Inon wrote. “Revenge is not going to bring my parents back to life. It is not going to bring back other Israelis and Palestinians killed either. It is going to do the opposite. It is going to cause more casualties. Keenly aware of the growing opposition to Israel’s war at home and abroad, and even within his own administration, Biden and his advisers have sought to push a narrative that they are seeking to moderate Israel’s tactics. They make sure the U.S. press know that Biden had urged against a full-scale ground invasion, proposed limited pauses to the bombing, and expressed concerns about the humanitarian crisis for Palestinian civilians. This is a yardstick of human civilization, not to hurt civilians.” Coming from Begin, the comments were striking, because he had been notorious as a leader of the Irgun, a militant group that carried out some of the worst acts of ethnic cleansing accompanying the creation of the state of Israel, including the 1948 Deir Yassin massacre. Instead, the New York Times focused on what it termed the “bitterest exchange” between Biden and Begin over the issue of Israeli settlements, which Biden opposed because, he said, it was hurting Israel’s reputation in the U.S. “He hinted — more than hinted — that if we continue with this policy, it is possible that he will propose cutting our financial aid,” Begin alleged.     A U.S. nonprofit has taken legal action against the Biden administration over support for Israel’s deadly assault on Gaza.

    On Monday the Center for Constitutional Rights (CCR) filed a lawsuit in Northern District of California against U.S. President Joe Biden, U.S. Secretary of State Antony Blinken, and U.S. Secretary of Defense Lloyd Austin for failure to prevent genocide and complicity in genocide.

    Plaintiffs include the human rights groups Defense for Children International–Palestine (DCIP) and Al-Haq, Great March of Return founder Ahmed Abu Artema, founder of the 2018 Great March of Return, Nasser Medical Complex physician Dr. Omar Al-Najjar, and DCIP field researcher Mohammed Ahmed Abu Rokbeh.

    “To be honest, it’s difficult to revisit all the scenes of the past weeks. They open a door to hell when I recall them,” said Al-Najjar in a statement. “I’ve lost five relatives, treated too many children who are the sole survivors of their families, received the bodies of my fellow medical students and their families, and seen the hospital turn into a shelter for tens of thousands of people as we all run out of fuel, electricity, food, and water. The U.S. has to stop this genocide. Everyone in the world has to stop this.”

    More than 11,000 Palestinians have been killed by Israel since Hamas’s October 7 attack. The United States government gives the country more than $3.8 billion in military aid annually, and Biden is currently lobbying Congress for another $14.5 billion. Last week, the president told reporters that there is “no possibility” of The White House calling for a ceasefire.

    “Genocide, the gravest of crimes under international law, defined in the Genocide Convention and implemented in U.S. domestic law at 18 U.S.C. § 1091 upon ratification, constitutes certain acts ‘committed with the intent to destroy in whole or in part a national ethnical, racial or religious group as such’ by, among other things: (i) killing members of the group, (ii) deliberating inflicting upon the group conditions of life calculated to bring about its physical destruction in whole or in part; and (iii) causing serious bodily or mental harm,” reads the complaint. “For the past 38 days, the world has watched senior Israeli officials use dehumanizing language in connection with their expressed intent to destroy and displace Palestinians in Gaza while imposing an unrelenting siege, and intentionally depriving Palestinians the conditions of life necessary for human survival. The Israeli military has dropped an estimated 25,000 tons of explosives on Palestinians in Gaza – the approximate explosive power of two nuclear bombs.”

    “For the last five weeks, President Biden and Secretaries Blinken and Austin have stood shoulder-to-shoulder with an Israeli government that has made clear its intention to destroy the Palestinian population in Gaza. As neighborhood after neighborhood, hospital after hospital, and sheltering displaced Palestinians were bombed, while subject to a total siege and closure that denies 2.2 million people basic necessities for life, they have continued to provide both military and political support for Israel’s unfolding genocidal campaign while imposing no red lines,” said CCR attorney Katherine Gallagher. “The United States has a clear and binding obligation to prevent, not further, genocide. So far, they have failed in both their legal, moral duty and considerable power to end this horror. They must do so.”

    In an October piece for Jewish Currents Raz Segal, an associate professor of Holocaust and genocide studies at Stockton University and the endowed professor in the study of modern genocide, called Israel’s assault on Gaza “textbook case” of genocide.

    “Israel’s goal is to destroy the Palestinians of Gaza,” wrote Segal. “And those of us watching around the world are derelict in our responsibility to prevent them from doing so.”

    William Schabas, the world’s leading legal expert on genocide, wrote in his declaration in the case, “I conclude that there is a serious risk of genocide committed against the Palestinian population of Gaza and that the United States of America is in breach of its obligation, under both the 1948 Genocide Convention to which it is a party as well as customary international law, to use its position of influence with the Government of Israel and to take the best measures within its power to prevent the crime taking place.”

    Earlier this month CCR, Palestine Legal, and the National Lawyers Guild wrote a letter warning congressional members that they faced potential legal liability if they backed Biden’s emergency military package to Israel.

    “Please take notice that should you vote in favor of that package, you risk facing criminal and civil liability for aiding and abetting genocide, war crimes and crimes against humanity under international law, and may face investigation and prosecution at the International Criminal Court, and in third-states under the principle of universal jurisdiction,” it read.

    NewsGuard Technologies Inc., an organization focused on combating “misinformation” in news media, along with the federal government (which has a contract with NewsGuard), is facing legal challenges over alleged defamation and First Amendment breaches, respectively. The plaintiff in the case is the Consortium for Independent Journalists, which initiated the litigation in the Southern District of New York.

    ...Founded in 1995 by the late investigative journalist Robert Parry, Consortium has contributed an impressive 27,000 articles to the journalistic landscape. Yet, amidst this vast collection, NewsGuard has taken issue five articles, the news outlet alleges, and, as a result of this has put a mark next to every news article on the site in its ratings system.

    The entirety of CN’s online archive now bears a red mark when viewed through search engines or social media platforms that use the NewsGuard system.

    “NewsGuard attaches an electronic ‘label’ to every CN item on search engines and social media that warns NewsGuard subscribers to ‘Proceed with caution’ because Consortium News ‘fails to maintain basic standards of accuracy and accountability,’ the complaint alleges. “Such statements slander and defame Consortium News and are arbitrary, wanton, malicious and reckless.”

    The lawsuit takes particular offense with NewsGuard’s system of attaching a label next to all articles from the outlet.

    And that list of bizarre deaths keeps growing. On May 7th, Bill Clinton’s former presidential advisor Mark Middleton was found dead in the most bizarre of circumstances.

According to authorities, Middleton trespassed on Heifer Ranch (which was located about 30 miles from his house) and used a table to construct makeshift gallows.

    Perry County Sheriff Scott Montgomery told Daily Mail:

    “I don’t know the man, and I don’t why he picked our county or picked that location to commit suicide. To our knowledge, he had never been there before, and we have no record of him being there before.

    He died from a self-inflicted shotgun wound to the chest. He found a tree and he pulled a table over there, and he got on that table, and he took an extension cord and put it around a limb, put it around his neck and he shot himself in the chest with a shotgun.

    It was very evident that the shotgun worked because there was not a lot of blood or anything on the scene. You can tell the shotgun blast was on his chest, you can tell that because there is a hole in the chest and pellets came out the back of his back. It was definitely self-inflicted in our opinion.”

    According to the sheriff, Middleton was “depressed”.

    Despite lots of unanswered questions, the death was quickly determined to be a suicide. Furthermore, the sheriff stopped speaking with the press due to the fact that the Middleton family filed a lawsuit preventing the release of information regarding this case. The lawsuit states that the family has “a privacy interest in preventing any ‘photographs, videos, sketches (or) other illustrative content’ from the death scene being released”, claiming that this material would lead to “outlandish, hurtful, unsupported and offensive articles’ being published online”.

    This lawsuit did not prevent people close to Middleton from voicing concerns. A business associate of Middleton is now calling for an independent investigation as he cannot believe that the man committed suicide. In an interview with RadarOnline, the associated stated:

    “Everyone that I know here, that has worked with Mark, knows it is physically impossible for Mark to have killed himself.”

    The associate also stated that Middleton dealt with companies close to the Clintons.

    Middleton was actively engaged in financial investments with the same Little Rock characters who allegedly worked with John Glasgow, the chief financial officer of CDI Contractors Inc., the lead firm that constructed the Clinton library.

    Glasgow vanished without a trace in 2008 after reporting financial irregularities with the Clinton library construction costs and his skeletal remains were found at Petit Jean State Park in 2015. His cause of death is undetermined.”

    “It didn’t make any sense, she would never kill herself,” the Haynes source said. “When I heard she went missing I knew instantly it was foul play. I don’t believe she killed herself. How could she water paddle down the river with a concrete block!”

When one analyzes the circumstances surrounding each death, a pattern emerges: No suicide note, no in-depth investigation, and little to no media coverage.
