Is UN torture expert overlooking Israeli abuses? Ukrinform ABACA Last week, the UN special rapporteur on torture visited the Israeli towns attacked on 7 October 2023. As rumors that a ceasefire deal was near swirled in the media, Alice Jill Edwards reiterated her call for the “immediate and unconditional release of the hostages” held in Gaza since that date. “This is an unlawful act under international law. It’s an atrocity. It’s a war crime,” she said. Edwards told Reuters that she “had written to the Palestinian Authority about independent and verifiable reports of sexual torture and violence that occurred,” the agency reported, paraphrasing the UN expert. Edwards added that she would speak to Israeli officials about allegations of torture and abuse of Palestinians in its detention centers. But Palestinian human rights groups say that Edwards has ignored their extensive documentation of the “widespread use of sexual violence as a form of torture against Palestinian prisoners and detainees.” “Lack of meaningful action” In a letter signed by the Palestinian Human Rights Organizations Council and the Palestinian Non-governmental Organizations Network, the groups call out “what we perceive as a lack of meaningful action, responsiveness and impartiality” regarding Israeli abuses. They say that they will no longer engage with Edwards due to her failure to acknowledge “the lived realities of Palestinians.” The groups point out that Israel is holding the highest number of Palestinian prisoners in its history – more than doubling the number of Palestinians held before October 2023. And this doesn’t include the “thousands of Palestinians abducted from Gaza by Israeli forces and held in ad hoc military detention camps.” Not only has the number of Palestinians held by Israel sharply increased. “The scale and severity of crimes committed against Palestinian prisoners and detainees in every phase of their custody” has dramatically escalated too, the Palestinian groups say. At least 49 Palestinians have been killed or died in Israeli custody since 7 October 2023, though “the actual number is likely to be higher,” the rights groups add. The groups said that a confidential submission detailing the widespread use of sexual torture against Palestinian prisoners and detainees was given to Edwards. But she did not co-sign statements from fellow UN special rapporteurs “highlighting its use against Palestinians, including women and girls.” Nor did Edwards include the information provided by Palestinian human rights groups and the Palestinian Authority regarding Israel’s use of sexual torture in her latest thematic report to the UN General Assembly that was focused on the issue. Instead, the Palestinian groups say, the report by Edwards treats “Israeli violations as mere ‘allegations’ while describing crimes against Israelis as substantiated ‘evidence’ ” and falsely claims that the notorious Sde Teiman detention camp was closed. “Finally, it takes Israel as an example of good practice in supporting survivors to recover from sexual torture,” the groups added, “without any mention of Palestinian detainees, Palestinian victims and the treatment of Palestinian survivors.” The groups said they repeatedly tried to engage with Edwards “on critical issues” including Israel’s total warfare on civilians in Gaza, the targeting and killing of journalists in the territory and the escalated attacks on Palestinians in the West Bank – particularly violent mass arrests. But these evidence-based interventions have not been adequately acknowledged or investigated by Edwards, despite the “severity and entrenched nature” of Israel’s use of torture and violations of international law. Stark contrast In this context, Israel’s decision to allow Edwards to visit is notable. The welcome she received is in stark contrast to how Tel Aviv has barred entry since 2008 to the UN special rapporteur on human rights in the occupied Palestinian territories, including the current holder of that mandate Francesca Albanese. Unlike Edwards, Albanese is outspoken about Israel’s violations of Palestinians rights and has faced a relentless smear campaign by the US and the Israeli government and its lobby groups in retaliation. This suggests that Israel grants and denies entry to UN experts based on Tel Aviv’s perception of their usefulness to its propaganda. The only public output from Edwards concerning the ongoing genocide in Gaza were two brief statements issued in May and in August. She sent only one communication to Israel in May. In one of those interventions, Edwards called for the transparent and impartial investigation of Israeli soldiers accused of raping a Palestinian detainee and for those responsible to be “held accountable by civilian courts of law.” Israel is not likely to carry out such an impartial investigation or prosecute those responsible in civilian courts, to say the least. Karim Khan, the chief prosecutor of the International Criminal Court, appeared to acknowledge this reality in his May announcement that he was applying for arrest warrants of Israeli leaders. He asserted that the court defers to national authorities “only when they engage in independent and impartial judicial processes that do not shield suspects and are not a sham.” Last month, the Israeli daily Haaretz reported that despite the deaths of dozens of Palestinian detainees in Israeli military custody, the military has not brought to trial any cases involving the death of a detainee. Evidence Edwards’ signature is notably absent from the many joint statements issued by her fellow independent UN human rights experts raising alarm and urging action to end the genocide in Gaza. But in January, Edwards co-signed along with Morris Tibdall-Binz, the UN special rapporteur on extrajudicial executions, a statement demanding accountability for victims of sexual torture and unlawful killings during the 7 October 2023 attack. “The growing body of evidence about reported sexual violence is particularly harrowing,” Edwards and Tibdall-Binz stated. “Allegations of sexual torture include rapes and gang rapes, sexual assaults, mutilations and gunshots to genital areas.” A later report by an independent UN commission of inquiry, based on a thorough review of thousands of open-source items and hundreds of documents, pointed to “a pattern of sexual violence” corroborated by digital evidence. But the commission said it was unable to verify any allegations specifically of rape and that Israel obstructed its efforts to investigate such widely reported claims. The commission also notes “the absence of forensic evidence of sexual crimes committed on 7 October.” That commission also said that it was “unable to verify reports of sexualized torture and genital mutilation” and “found some specific allegations to be false, inaccurate or contradictory with other evidence or statements and discounted these from its assessment.” A UN rapporteur like Edwards ought to be particularly sensitive and cautious on this matter, since false claims about 7 October rapes made by politicians from various countries allied with Israel have been repeatedly debunked. There is a persistent lack of credible evidence to substantiate Israel’s claims of rapes and other sexual violence by Palestinians on 7 October 2023. This lack of evidence stands in contrast to the growing body of testimonies and other documentation of systematic sexual torture of Palestinian prisoners and detainees, thousands of whom are forcibly disappeared with their loved ones having no information of their whereabouts. Edwards’ upcoming report to the Human Rights Council will focus on hostage-taking as a form of torture. In their letter to Edwards, the Palestinian human rights groups said that centering this theme rather than the mass arrests and widespread torture of Palestinians “is yet another example of a troubling pattern that suggests you perceive Palestinians as less worthy victims.” In a call for submissions, Edwards described hostage-taking “as a form of manipulation, coercion and leverage in the hands of both state and non-state actors” – with human beings reduced to bargaining chips in “a cruel game.” She added that “recent data reveals that state actors now represent significant players” in the use of hostage-taking, whereby individuals are arbitrarily detained to be used as political pawns. It remains to be seen whether Edwards will include the Palestinians being held without charge or trial or otherwise arbitrarily detained by Israel among the victims of hostage-taking as a form of torture. In addition, large quantities of weapons were also provided from the existing Pentagon arsenals. Private military companies’ involvement in Ukraine is quite limited. Most of their services in other countries were primarily aimed at low-intensity conflicts, and their opponents were partisan or rebel formations in various countries. In such situations, private military companies could provide effective protection of communications, facilities, and property or participate in low-intensity battles against regular units. However, the Ukrainian conflict is a war of large armies, an artillery war and a drone war. Private military companies, which are used to operating in low-intensity conditions, are not the best suited for the Ukraine War, which is why they have suffered heavy losses defending the Kiev regime. By the end of 2023, the peak of mercenaries in Ukraine had passed. Today, there are significantly fewer than before. In many cases, their families never find their bodies. According to reports in March, almost 13,400 foreign mercenaries had arrived in the war-torn country to fight against the Russian army. By then, about 6,000 had been eliminated. According to the Russian military, most of the mercenaries came to Ukraine from Poland, the United States, Canada, and Georgia. As for salaries, the Ukrainian government does not particularly enrich foreign mercenaries, so they are paid the same as regular soldiers and officers of the Ukrainian army. For many in Latin America, for example, a little money motivates them to be cannon fodder. However, other mercenaries, such as highly qualified specialists, are hired to service complex Western equipment. Ukraine has adopted a law that allows foreign citizens to serve in the Armed Forces of Ukraine and hold officer and command positions, officially legalizing their participation in the army’s structure. This confirms that cooperation with foreigners in the military continues and that they are attempting to fill the shortage of qualified personnel in the Ukrainian military. Regarding the influence of private military companies on the conflict and the course of the special military operation, the greatest influence is exerted by highly qualified specialists working on the maintenance and use of Western weapons, which are now crucial in this conflict, as they enable the achievement of tactical and operational goals. That was before the murderous blitzkrieg they called Operation Cast Lead and subsequent massacres, but Israel’s crimes against humanity were already piled high. When I got home memories of the visit so haunted me that I sat down and wrote an article titled “See Gaza and Weep” describing my impressions in November of 2007. flattening Gaza to the ground SEE GAZA AND WEEP Traffic into Gaza through the smart new border ‘facility’ at Erez is down to a trickle since Israel branded this tiny Palestinian seaside enclave a “hostile entity” and imposed a blockade even harsher than before. We came to Gaza to visit Fr Manuel Musallam, who ministers to his flock, runs the excellent Catholic school against all odds and is revered as a local hero. If he leaves Gaza the Israelis won’t allow him back, so for 9 years he has stayed put, isolated. When he heard we were coming, said a colleague, he burst into tears. After a noisy arrival at breakneck speed, with police sirens blaring Palestinian-style, our visit quickly turned into a media circus. An unlikely cavalcade of priests, interpreters, teachers, cameramen and Hamas armed police then took off to inspect the Rafah crossing into Egypt, now closed indefinitely, then followed the iron barrier down to the sea and the coast road back to the city. I noted the deserted beaches and disused fishing boats… Israel has banned fishing off the Gaza coast, ruined the livelihood of 3000 fishermen and deprived local people of a proper diet. Boats defying the ban are fired on. The Gaza Strip is sealed off from the outside world with an Israeli fence guarded by watchtowers, snipers, tanks, armoured bulldozers and drones. Israel pretended to withdraw two years ago but still controls Gaza’s airspace, coastal waters and airwaves. It has the place bottled up like a prison and makes frequent incursions. Much of it is blasted to rubble but many fine buildings survive. So does the defiant community. One can easily imagine Gaza blossoming into a coastal paradise, but right now the strangulated economy is in free-fall and for 1.5 million ordinary folk life is hell. Unemployment stands at 65%, and 80% live below the poverty line. Fuel is running out, so are basics like washing powder. Shattered infrastructure and food shortages mean serious public health problems. Power cuts disrupt hospitals and vital drugs cannot be kept refrigerated. Thousands look death in the face as medi-care collapses. [Adel Hana/AP Photo] We were also there to show solidarity with the whole population, Muslim and Christian, against the crippling economic sanctions that have led to this crisis. According to the Ministry of Health 450 cancer patients (35% of them children) are forbidden to leave Gaza for treatment or surgery. Many go without medication because cancer drugs are blocked or delayed at the border. There’s no radiotherapy. 400 renal failure patients should be getting dialysis three times a week but 20 of the 69 machines are out of action – no spares – and treatment has been cut to twice a week. 400 cardiac patients suffer unnecessarily owing to shortage of drugs. Spares for therapeutic and diagnostic equipment cannot get through. Hospitals are completely out of many essential medical and psychiatric drugs, X-ray bags and sterilisation bags. They are dangerously short of dressings, other disposables and cleaning materials. When the 2 weeks’ supply of anaesthetics is finished the operating theatres will close. Fuel stocks may last 15 days with luck, but there’s no patient food until MAP UK aid arrives. Physicians for Human Rights (Israel) say they have been trying to bring the critically ill out of Gaza for proper treatment, but are often refused. So they die in agony. A thousand patients – advanced kidney and cancer cases and victims of Israeli air-strikes – need immediate transfer. Channel 4 News screened a shocking report on UK TV about how the sick are blackmailed. If they agree to inform on relatives they are allowed to cross the border. If not they can “stay in Gaza and die”. The Red Cross repeatedly reminds Israel of its obligation under international law and the Geneva Conventions to ensure that humanitarian supplies reach Palestinian civilians. However, I’m told that drugs purchased from sales of my book ‘Radio Free Palestine’ cannot be delivered in the normal way and will have to be smuggled in somehow. The European Parliament in October passed a resolution calling on Israel to lift the blockade and guarantee humanitarian aid and essential supplies of electricity and fuel. Israel responded by declaring Gaza a “hostile entity” and announced more sanctions. As guests in the community we were invited for coffee at the House of Fatah and the residence of Hamas prime minister Ismail Haniyeh. It was a relief to see that relations between religious and political factions are friendly and good-humoured at such a difficult time. Taking our leave was double torture… the wrench of saying farewell to a brave people that Western governments are persecuting, and the prospect of once again running the gauntlet of Erez’s high-tech security procedures and questioning, which this time took 3 hours while Qassam rockets flew over and exploded on the Israeli side. They seldom do any damage but indiscriminate targeting of civilians by both sides is deplorable. Gaza was formerly under British mandate, which is surely reason enough to feel a special responsibility. In better days a kindlier British government might have landed supplies on Gaza’s empty beach and lifted the siege. Indeed, there are many things a kindlier British government might have done to set the Palestinians free. How different now. The appalling situation, created with Britain’s help, is designed to force democratically elected Hamas into submission and bring a sick and demoralised community meekly back under Abbas’s puppet regime. Meanwhile the subjugation and dispossession of Christians and Muslims in the Holy Land continues. It remains a mystery to me why our largely Christian (but increasingly Muslim-inclusive) democracy in the UK so slavishly supports the Middle Eastern ethnocracy that’s doing this… Question: What has changed for the better? Answer: Nothing. And that sums up the achievement of Mahmoud Abbas’s over-long stay as Palestinian president. Some say Abbas isn’t a bad guy, he just lost his way. Actually there’s a long crime-sheet against him. A founding member of Arafat’s Fatah faction, he ‘won’ the presidency of the Palestinian National Authority in January 2005 in a dodgy contest – let’s not dignify it with the word ‘election’ – in which Israel seriously interfered to obstruct other candidates. He has overstayed his 4-year term by nearly 3 years and is widely regarded as having no legitimacy and no popular mandate. Legitimate or not, he is still propped up by the US, Israel, Britain and those other beacons of democracy. According to the Constitution the presidency should by now have devolved to the Speaker of the Legislative Council, Aziz Duweik. But that could never be permitted because Duweik, although a professor with a PhD from the University of Pennsylvania, is also a member of Hamas. So Abbas clings to office like used chewing-gum to the sidewalk. In 2007 he dissolved the Hamas-led unity government, of which Haniyeh was prime minister, and appointed Salam Fayyad in his place, a move that was almost certainly illegal under Palestinian Basic Law and designed to ensure the disunity and weakness that Israel so badly wanted to see. Since the Palestinian Legislative Council never approved Fayyad’s appointment, many Palestinians regard Haniyeh as the caretaker PM although his authority, as a result of Abbas’s treachery, is now confined to Gaza. In all probability Fayyad has no more legitimacy than Abbas. When he took up the post of president, Abbas would have sworn this solemn oath… “I swear to God almighty to be faithful to the Homeland and to its sacred places, and to the people and its national heritage, and to respect the Constitutional system and the law, and to safeguard the interests of the Palestinian people completely, as God is my witness.” We’ve seen how he respects his country’s Constitutional system. He was further undone by the Wikileaks suggestions that the Israeli government “consulted with Egypt and Fatah prior to Operation Cast Lead, asking if they were willing to assume control of Gaza once Israel defeated Hamas”. And only a few days ago Abbas was safeguarding the interests of the Palestinian people by announcing on Israeli TV, of all places: “Palestine now for me is ’67 borders, with East Jerusalem as its capital. This is now and forever … This is Palestine for me. I am [a] refugee, but I am living in Ramallah. I believe that [the] West Bank and Gaza is Palestine and the other parts [are] Israel.” In other words, he relinquishes the Palestinian refugees’ right to return to their lands and homes and even surrenders his own right to return to his birth town Safad, which is now a district in northern Israel. “We don’t want to use terror,” he says. Agreed. Perish the thought. “We don’t want to use force. We don’t want to use weapons…” he says. But Palestinians have a perfect legal right to use any means to repel a foreign occupier. “We want to use diplomacy. We want to use politics. We want to use negotiations…” Has he learned nothing from 64 years of non-stop ethnic cleansing and failed diplomacy? The Israelis by all accounts are jubilant. Their Top Stooge has scored for them again. But Haniyeh is not amused. “It is not possible for any person, regardless of who he is … to give up a hand’s width of this Palestinian land, or to give up the right of return to our homes from which we were forced out…” If you visit the Holy Land, Palestinians will urge you to tell their story when you get home. But does Abbas bother to tell it? How many activists, supporters, sympathizers, journalists and writers have had a chance to meet this great leader of the Palestinian underdogs… to be enthused by him… to question him? When he comes to London for “talks” it’s hush-hush. We never hear about it. His good-for-nothing embassy says nothing. His worse-than-useless press office in Ramallah says nothing. In the struggle for their rights and independence the Palestinians have international law and UN resolutions on their side. But in the seven years Abbas has presided the West Bank has remained sealed, the theft of Palestinian land has continued unabated and the blockade on Gaza has not eased – it’s been tightened. Palestine goes on losing more than it gains. The bottom line is that in the 21st Century – this new age of enlightenment – Palestinians remain prisoners in their own country. How miserably must a leader fail his people before they kick him out? And how much longer will Western leaders continue to shirk their responsibilities towards our Christians and Muslims brothers and sisters in the Holy Land? Fast-forward 12 years and today the loser Abbas is still there, widely regarded as a quisling and achieving nothing for his own country… but still doing Israel many favours. Who, in 2007, could have believed that for 14 months in 2023/4 the international community would stand by and do nothing to stop the apartheid regime in Israel exterminating Palestinian civilians, women and children in their own homeland in revenge for their having struck back against over 7 decades of Israeli illegal and brutal military occupation, dispossession, theft of their lands, livelihoods and resources, and interference with their lives at every level? Who, in 2007, would have believed that the US and UK — those champions of democracy, freedom and self-determination — would be supplying Israel with the munitions and other wherewithall to carry out a full-blooded genocide? Who, in 2007, would have believed that the people of the US and UK could allow their sick-minded politicans to behave in such a despicable way? And who, in 2007, would have thought Western Christendom would be so spineless as to stand idly by watching their Christian and Muslim brothers and sisters being cruelly slaughtered in Gaza and the West Bank — the very wellspring of their faith — and not even raise a whimper never mind mobilise their millions in opposition to such downright evil. Yet, despite the delusions of the West, the Hungarian Prime Minister continues to work towards peace in Ukraine and to ensure the flow of Russian energy to Ukraine. Orbán believes that US President-elect Donald Trump, who is prepared to fight for the spiritual and civilizational future of the West alongside patriots, is preparing to come to power in Washington and completely change the Western world. “I already live mentally in this new reality, and the Hungarian government is already there. And in Brussels, they are still in the old reality, which was before the big changes. And they say everything can be done as they have done so far. Completely delusional. They will pay dearly for this,” Orbán told broadcaster M1 on December 22. The Hungarian prime minister previously said that Europe and the US spent a total of 310 billion euros on Ukraine, which was a “nightmare” amount. If this money had been invested in the economy, European citizens would be living much better today, and it would have been possible to “work miracles.” He also recently stated that the world economy risks splitting into Western and Eastern blocs as a result of the West’s suicidal policies, to which anti-Russia sanctions are also related. Hungary does not want to belong to either bloc and intends to maintain close economic ties with both. Earlier this month, Ukrainian president Volodymyr Zelensky again criticised Orbán for communicating with Russian President Vladimir Putin in a phone call. The Hungarian and Russian leaders discussed the possibility of establishing a “lasting and sustainable” peace in Europe and a Christmas ceasefire. Orbán also presented the idea of ​​a prisoner exchange, which was also conveyed to Zelensky through diplomatic channels, but, according to the Hungarian leader, he “rejected and discarded” the idea. I think we cannot give in to this,” Szijjarto told local media. Zelensky tried to prevent Orbán from acting as a mediator in negotiations to resolve the conflict in Ukraine. On December 18, in response to Zelensky’s accusations, Orbán stated that he would not give in to provocations, that the ceasefire proposal is still in force and that the Ukrainian president himself must take responsibility for accepting it or not. Budapest has consistently blasted the anti-Russia sanctions imposed by the European Union and the US, highlighting how this decision has only led to the decline of the bloc’s collective economic and industrial power since the effects have only boomeranged. This decline is attributed to Europe now purchasing expensive energy in an effort to boycott Russia. Instead, Europe still receives Russian energy, primarily via third parties, such as India and Azerbaijan. Even in this issue, Hungary is the only country of the 27-member bloc to attempt to resolve it seriously. These are dilemmas no human should ever have to endure, yet recent research by Action For Humanity found that 98 percent of the 200,000 people in the “humanitarian zones” in central Gaza have had to wrestle with them. It’s hard to say exactly what’s happening in the moment, but I will say it’s mighty convenient how Russia being tied up in Ukraine and Hezbollah being decapitated by Israel leaves Syria once again exposed to the longstanding regime change agendas of the same western empire who’s been backing both of those proxy conflicts. https://x.com/caitoz/status/1862615294340211104 ❖ Syria is more complicated and harder to understand than Gaza, but if you look into it you’ll find mountains of evidence that for many years the US and its allies and partners have been actively fomenting violence, chaos and destruction in that nation to effect regime change. There are a lot of people who see through the imperial lies about Gaza but still buy into the imperial lies about Syria, largely because the lies about Gaza are so much easier to see through. But if you bring the same sincere curiosity and rigorous investigation to this issue that you brought to the plight of the Palestinians, you will discover the same kinds of lies and distortions which you’ve seen the western political/media class promote about Gaza being spun about Syria as well — frequently by the same people. This is how unpacking the lies of the empire tends to unfold for folks. Your eyes flicker open because of some really obvious plot hole in the official narrative like Vietnam, the Iraq invasion, or Gaza, and then once you’ve seen through those lies you start getting curious about how else you’ve been deceived. You start pulling on other threads and learning more and more, and then after a while you start seeing the big picture about the US-centralized empire inflicting horrific abuses upon humanity all around the world with the goal of dominating the planet. If you saw through the lies about Gaza, don’t stop there. Keep going. Keep pulling on threads. Keep learning. Stay curious. They lied about Gaza, they lied about Iraq, they lied about Libya, they lied about Ukraine, and they’re lying about Syria too. Don’t listen to anyone who tries to dull your curiosity. Ignore anyone who tries to shout you down and shut you up for asking inconvenient questions. Now the line is “Well this is obviously a proxy war so we need to give our proxies more weapons, duh!” ❖ We’re taught that heroes look like western soldiers and cops taking out bad guys, when really heroes look like Palestinian journalists risking everything to tell the truth about genocidal atrocities that are backed by western governments while western journalists make propaganda. ❖ I don’t want the Australian government to ban kids from social media, I want the Australian government to stop supporting Israel’s genocidal atrocities and stop turning this country into a giant US military base in preparation for Washington’s war with China. ❖ It should be illegal to force homeless people to relocate. If a rich neighborhood is the best place to sleep rough then the rich should be forced to look at a daily reminder of the dystopia they live in until the underlying problems which cause homelessness have been fixed. You shouldn’t be allowed to hide such things to make people comfortable. All the laws designed to criminalize homelessness and force the unhoused to relocate are just one more way our dystopia hides its abuses and contradictions from public view, the same as propaganda and internet censorship and murdering Palestinian journalists. They want the homeless out of sight and out of mind in the same way their wars and genocides are out of sight and out of mind. They just want the homeless to go “away”, because they can’t fix the injustices and inequality which cause homelessness without upending the power structure they rule.
